Money claim on behalf of the tenant – Tenant / our client left the property – Requested return of the deposit – Landlord refused – We took the matter in the court – got default judgement – Landlord / debtor filed Application Notice (N244 FORM) and requested for setting aside the Judgement – On first hearing – Debtor Application dismissed and court ordered

In this case, we represented the ex-tenant. He paid the deposit to the landlord. However, after leaving the property and after giving the clean property to the landlord, he requested for the return of the deposit. The landlord refused to acknowledge any requests and refused to return the paid deposit. We sued the landlord for the compensation for three times and the return of the original deposit. The landlord never responded back to the claim. We got Judgement in Default. Before executing the Judgement through High Court Enforcement Officers, the landlord filed Application Notice in the court and request for setting aside the Judgement. We appeared in the court and with our very robust arguments and case management skills, after the argument of approx. 30 minutes, the court dismissed the debtor Application Notice and ordered him to:-
